當初這組合消息一放出來，馬上跟朋友兩人一起合購，一人一套 (我這朋友有長期直接從AMAZON購回台灣的紀錄) 昨天臉書上他告訴我一個不好的消息，他只留個言丟個網址給我因為他人在印度工作，我是在大陸工作，所以我們都只有偶爾臉書留言留資訊這樣詳細狀況，例如我想問他AMAZON是否有給他關於是否正常配送的通知書還是其他什麼的通知之類的，一時之間也還沒聯絡上他，無法得到更多消息不過看完覺得還是可以賭一賭吧消息來源↓ 9/1的新聞了 http://www.thehdroom.com/news/Marvel-Cinematic-Universe-Phase-One-Avengers -Blu-ray-Pre-Orders-Halted/11151 縮址：http://tinyurl.com/94va3yv Bad news today on the Marvel Blu-ray front. Online retailer Amazon.com has stopped taking pre-orders for Marvel Cinematic Universe: Phase One - Avengers Assembled on Blu-ray, just a few weeks shy of its September 25 release date alongside the home video debut of The Avengers. 目前Amazon已全面停止這個手提箱版的復仇者藍光豪華套裝預購。 (確實連上Amazon打入品項名稱，就連產品圖也都下架了) Amazon's reason for the inavailability of the set is because it is "currently under review." The likely reason stems from an ongoing legal squabble between Marvel and Rimowa, the company who created the metallic briefcase that the set is modeled after. According to the lawsuit filed on August 1, 2012, Rimowa claims that Marvel Entertainment and Buena Vista Home Entertainment have conducted trademark infringement, unfair competition and trademark dilution. More specifically, Rimowa states that Marvel nor Buena Vista/Disney sought permission to use the trademarked horizontal bands that give the metallic cases their unique look. Amazon方表示，此事件主要原因是手提箱的製造商Rimowa (查了一下是一間德國公司，跨海到美國提出司法程序) 控告Marvel Entertainment與 Buena Vista Home Entertainment進行了商標侵權。說詳細一點，就是Marvel與 Walt Disney皆沒有得到Rimowa的同意就進行了改造手提箱使之成為這個典藏版藍光套裝的使用。這文中是只有講"改造"啦，我查了一下網路有看到這段關鍵字： Marvel did not obtain any license or authorization from Rimowa to make replica copies of the cases for any purpose 如果是後者的話，代誌就更大條了。按：Buena Vista 乃是 Walt Disney Studios Home Entertainment 發行藍光與DVD產品的品牌名稱 No one is sure what will happen at this point. The lawsuit could continue on into the courts, which would significantly delay or cancel the Marvel Cinematic Universe: Phase One - Avengers Assembled Blu-ray set as it appears today. Marvel and Rimowa could settle out of court between now and September 25, giving us the sets as-is on the original release date. Marvel and Disney could also opt to alter the packaging and release the set at a later date. In my opinion this is a worst-case scenario. 那以現在這狀況來看，也還不確定到了9/25上市日期時會發生什麼事。有可能25號之前雙方達成共識解決商標的問題，那就可以如期發貨；Marvel與Disney也有可能採用其他的包裝方式而延後上市日期(也就是Rimowa勝訴)，當然這是大家最不想看到的狀況。 What should you do if you have already pre-ordered Marvel Cinematic Universe: Phase One - Avengers Assembled on Blu-ray? I wouldn't cancel it, that's for sure. There's a chance that those who pre-ordered will still get the set regardless of the lawsuit. Or, the lawsuit could not be involved at all and Amazon has sold through their allotment. You just never know. 這邊原發文者當然理想化了一下，當然這個也是影迷想要的結果。現在這事有各種可能性，他覺得當然不可能取消訂單，就算法律程序未明朗，Amazon還是有可能就無視狀況直接發貨，也有可能Amazon根本不會受到牽連，進而直接把已經進到庫存的貨直接發出我是不曉得Amazon有沒有遇過類似案例啦，但就這個狀況來看，既然知道這件事已經進行法律程序，那就不太可能無視其狀況而直接配送出去，因為淌這灘混水的結果可大可小。主要還是要看德國公司要做到什麼樣的地步啦，我覺得。如果只是要一個credit，那Marvel跟Disney就乖乖地把該做的做一做，該付的付一付，不要讓整件事進到判決的地步，能和解就和解，畢竟已經建立起整個英雄電影的品牌與形象，已經放出來的消息以及包裝最好就是以原本說定的型式來發佈，對影迷漫迷都有個交代，而Rimowa的產品也可以趁此機會炒作一下。個人認為這個可能性是比較高啦，就好比歌手影星要發表新作品時不時會來個花邊新聞炒作的方式。除非Rimowa真的就是直接罔顧影迷漫迷的期待，說什麼就是不爽讓Marvel與Disney用他們家的產品來做行銷，或者就根本要給老美一個教訓，教訓你為什麼連個許可都沒跟我詢求。 OK，以這樣來說當然可以輕易勝訴，但這樣一來贏了面子，卻未必贏了裏子.. 因為苦苦等候的影迷漫迷真的望穿秋水這個包裝啊 Q_Q -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 58.252.68.50
